Terms of Use

These Terms of Use govern access to and use of The Silent Signal (the "Service"), a web-based team diagnostic operated by:

referred to as "we", "us" or "our".

By accessing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service. The contract language is English.

1. What the Service is

The Silent Signal is a seven question diagnostic that generates a system-level snapshot of how a team is experienced from one person's perspective. It is designed as an input for professional reflection and conversation.

The assessment reflects the perspective of a single respondent at a single point in time. It does not represent an objective or verified assessment of any team, organisation, or individual. Results may vary significantly depending on the respondent, their role, their current context, and the moment in which the assessment is completed.

The Service is not a performance evaluation tool for individual employees. It is not a medical, psychological, or therapeutic assessment. It is not legal, financial, or human resources advice.

The outputs are interpretations generated from your responses. They are not empirical measurements, validated psychological instruments, or factual statements about any individual or organisation. You decide what to do with them.

2. Who can use the Service

The Service is intended for professional use by adults aged eighteen or over.

If you use the Service in a professional capacity on behalf of a team or organisation, you are responsible for ensuring that your use complies with your organisation's internal policies and that any team members involved understand the purpose of the assessment and how the results will be used.

If you share your results with colleagues, managers, or other members of your organisation, you do so at your own discretion and risk. We are not responsible for how results are interpreted or used by third parties to whom you choose to disclose them.

3. Acceptable use

You agree to use the Service only in accordance with these Terms and applicable law.

You agree that you will not use the Service to collect or store sensitive personal data about identifiable individuals, including health data, disciplinary history, or data revealing racial or ethnic origin, political opinions, religious beliefs, trade union membership, or sexual orientation.

You agree that you will not enter the full names of individual employees or colleagues in any part of the Service.

You agree that you will not use the Service to make or support disciplinary decisions about specific individuals.

You agree that you will not attempt to reverse engineer, decompile, copy, reproduce, or otherwise extract the source code, logic, questions, scoring methodology, case library, report structure, or any other proprietary element of the Service, whether in whole or in part.

You agree that you will not reproduce, republish, or distribute the content, outputs, or structure of the Service without our prior written consent.

You agree that you will not attempt to bypass security measures, access data belonging to other users, or interfere with or disrupt the Service or its infrastructure.

You agree that you will not use the Service in any way that is misleading, discriminatory, or unlawful.

4. Suspension and termination

We may suspend or terminate access to the Service if we reasonably believe these Terms have been breached, the Service is being misused, or we are required to act by law or by a competent authority. Where reasonable we will give prior notice. Where necessary to protect the Service or other users we may act immediately without notice.

5. Intellectual property

All content in the Service, including the questions, dimensions, scoring logic, case library, labels, narratives, reports, visualisations, text, and design, is our original work and is protected by copyright and other intellectual property law automatically upon creation, without the need for registration. All rights are reserved.

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service and view its outputs solely for your own internal professional purposes.

You may not resell, sublicense, reproduce, or redistribute the Service or its outputs in any form. You may not offer the Service, its methodology, its questions, or its outputs as a product or service to third parties without our prior written consent. You may not remove or alter any copyright, branding, or attribution notices in the Service or its outputs.

6. No professional advice

The Service provides a system-level interpretation based on the responses you submit. It does not account for your specific organisational, legal, employment, or regulatory context.

The results of the assessment should not be used as the sole or primary basis for any employment, organisational, or personnel decision.

You are solely responsible for interpreting the results, deciding what actions to take, and complying with applicable employment, data protection, and other laws relevant to your organisation. Where needed, seek advice from qualified legal, human resources, or other professional advisers before acting on the results.

7. Availability and changes

We aim to keep the Service available and reliable but we do not guarantee uninterrupted operation, a specific level of uptime, or error-free performance.

We may at any time modify the questions, scoring logic, features, or design of the Service, suspend parts of the Service, or discontinue the Service entirely.

The Service is currently provided free of charge. We reserve the right to introduce paid features or access tiers in the future.

8. Data and privacy

Our handling of personal data is described in our Privacy Notice, which forms part of these Terms. By using the Service you acknowledge that your data will be processed in accordance with the Privacy Notice.

9. Disclaimers

To the extent permitted by applicable law the Service is provided on an as-is and as-available basis without warranties of any kind, whether express or implied.

We do not warrant that the results of the assessment are complete, exhaustive, or objectively correct. We do not warrant that use of the Service will lead to any particular outcome for you or your organisation.

10. Limitation of liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under German law. This includes liability for intentional misconduct, gross negligence, injury to life, body or health, liability under the German Product Liability Act, and any other mandatory liability under applicable law.

Subject to the above, and to the maximum extent permitted by law, we are not liable for any indirect, consequential, or special loss arising out of or in connection with your use of the Service.

Since the Service is provided free of charge, our total aggregate liability for all claims arising out of or in connection with the Service is limited to one hundred euros (EUR 100).

11. Governing law and jurisdiction

These Terms and any dispute arising out of or in connection with them or the Service are governed by the laws of the Federal Republic of Germany, excluding its conflict of law rules.

If you are a merchant within the meaning of the German Commercial Code (Kaufmann), a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Bonn, Germany.

12. Changes to these Terms

We may update these Terms from time to time. The updated version will be published on this page with a revised last updated date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Severability

If any provision of these Terms is or becomes invalid or unenforceable, the remaining provisions remain in full force.

14. No waiver

Failure to enforce any right or provision under these Terms does not constitute a waiver of that right or provision.
